1. Introduction & Acceptance of Terms

Welcome to our online coaching and learning marketplace platform Studysaarthi. These Terms & Conditions govern your access to and use of the Platform, including all services, features, content, and products offered through it. By accessing, registering on, or using the Platform as a tutor, instructor, coaching center, or student, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree with any part of these Terms, you should not use the Platform.

2. Definitions

For these Terms:

“Platform” refers to the online marketplace that facilitates the listing, sale, and purchase of educational products and services.

“Tutor” refers to any independent instructor, educator, or coaching center that lists or sells educational content on the Platform..

“Student” refers to any user who browses, purchases, or enrolls in educational offerings on the Platform. .

“Content” includes courses, videos, live classes, study materials, PDFs, notes, assessments, and any other educational material. .

“Third-Party Payment Provider” refers to external payment gateways or financial institutions used to process payments or EMI facilities.

3. Eligibility to Use the Platform

You must be legally capable of entering into a binding agreement to use the Platform. By using the Platform, you represent that you meet the minimum age and legal requirements applicable in your jurisdiction. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. Account Registration & Responsibilities

To access certain features, Users must create an account by providing accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted through your account. The Platform shall not be liable for any loss or damage arising from unauthorized use of your account due to your failure to safeguard your credentials.

5. Role of the Platform (Marketplace Disclaimer)

The Platform acts solely as a technology-enabled marketplace that connects Tutors and Students. It does not create, own, endorse, or directly provide any educational content or services listed on the Platform. The Platform does not guarantee the quality, accuracy, legality, or outcomes of any course or material offered by Tutors. Any agreement formed for the purchase of educational content is strictly between the Tutor and the Student.

6. Tutor Responsibilities & Content Ownership

Tutors are solely responsible for the content they upload, publish, or sell on the Platform. Tutors represent and warrant that they own or have the necessary rights to use and distribute their content and that such content does not infringe any intellectual property rights or violate applicable laws. Tutors retain ownership of their content but grant the Platform a limited, non-exclusive license to host, display, promote, and distribute such content for Platform operations.

7. Student Responsibilities & Usage Rules

Students agree to use the Platform and its content solely for personal, non-commercial learning purposes unless expressly permitted. Students shall not copy, distribute, resell, share, or publicly display any content without authorization. Any misuse of content or violation of usage rules may result in suspension or termination of access.

8. Course Purchase, Pricing & Payments

All prices for courses and materials are set by the respective Tutors unless otherwise stated. The Platform facilitates payments but does not control pricing decisions.

Full Payment: Students may choose to make a one-time full payment for courses or products. Access to content may be granted immediately upon successful payment.

EMI / Installment Payments Where available, Students may opt for installment or EMI-based payment plans offered through third-party payment providers. The Platform does not provide credit and is not responsible for approval, interest rates, fees, or disputes related to EMI arrangements.

Third-Party Payment Gateways Payments are processed through independent third-party payment gateways. The Platform does not store sensitive payment information and is not responsible for errors, delays, or failures caused by these providers.

9. Refunds, Cancellations & Non-Refundable Items

Refund and cancellation policies may vary by Tutor and product and will be displayed at the time of purchase. Digital content, including recorded videos, downloadable materials, and accessed courses, may be non-refundable once accessed. The Platform reserves the right to deny refund requests that violate stated policies or where content has already been consumed.

10. Intellectual Property Rights

All intellectual property rights related to the Platform, including its software, design, trademarks, and branding, are owned by or licensed to the Platform. Unauthorized use of Platform intellectual property is strictly prohibited. Tutor content remains the intellectual property of the respective Tutor.

11. Prohibited Activities

Users shall not engage in activities that are unlawful, harmful, misleading, abusive, or disruptive. This includes uploading false information, infringing content, attempting to bypass security features, or using the Platform for unauthorized commercial purposes.

12. Platform Access & Service Availability

While the Platform aims to provide uninterrupted access, it does not guarantee continuous availability. Temporary disruptions may occur due to maintenance, updates, or technical issues. The Platform is not liable for any loss resulting from such interruptions.

13. Limitation of Liability

To the maximum extent permitted by law, the Platform shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of the Platform or reliance on any content. The Platform does not guarantee academic success, employment outcomes, or specific results from any course or material.

14. Indemnification

Users agree to indemnify and hold harmless the Platform from any claims, damages, losses, or expenses arising from their use of the Platform, violation of these Terms, or infringement of any rights of third parties.

15. Termination & Suspension of Accounts

The Platform reserves the right to suspend or terminate any account at its discretion for violations of these Terms, misuse of the Platform, or unlawful activity. Upon termination, access to content and services may be revoked without notice.
